1. Acceptance of Terms

By downloading, installing, accessing, or using PesaTu ("the Game") — a product published by EXM Games ("EXM", "we", "us") — you agree to these Terms and Services ("Terms"). If you do not agree, do not download or use the Game.

2. Eligibility

You must be at least 18 years old, or the legal age of majority in your jurisdiction, whichever is higher. By using the Game, you represent that you meet this requirement. EXM may request proof of age or identity at any time and may suspend or terminate accounts that cannot provide satisfactory verification.

The Game may not be available in all countries. You are responsible for determining whether your use of the Game complies with applicable laws in your jurisdiction. EXM may restrict access from certain countries or regions where required by law or where operating the Game would expose EXM to unacceptable legal or regulatory risk.

3. Accounts

You may be required to create an account to access gameplay features. You must provide accurate and complete information during registration and keep that information current. You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account.

Each person may maintain only one account unless explicitly permitted by EXM. Account sharing, selling, or transferring is prohibited. EXM reserves the right to suspend or terminate accounts that contain false information, are involved in fraudulent activity, or are used in violation of these Terms.

EXM may suspend or terminate accounts at its discretion, including for inactivity, violation of these Terms, suspected fraudulent or illegal conduct, or where required by law. Upon termination, your right to use the Game ceases immediately. Certain data may be retained as described in our Privacy Policy.

4. PesaTu Tokens (PTT)

PesaTu Token ("PTT") is the in-game currency unit used within the PesaTu platform. PTT enables participation in matches, and PTT balances are maintained in your account.

PTT is a platform-specific unit of account. PTT is not a cryptocurrency, not an investment instrument, and not a security. PTT does not represent equity, ownership, or any claim against EXM. PTT does not constitute a deposit account, e-money, or stored value under any financial regulation. PTT has no independent monetary value outside the PesaTu platform except where the platform provides an applicable redemption mechanism. EXM makes no guarantee regarding the future value, exchange rate, or redeemability of PTT.

5. Purchases and Payments

You may acquire PTT through supported payment methods made available within the Game. Supported providers and methods may vary by country and may change without prior notice. All purchases are processed by third-party payment providers. EXM does not store full payment card details.

Payment providers may impose minimum transaction amounts, maximum limits, processing fees, or other restrictions. It is your responsibility to review the terms of the payment provider before completing a transaction. EXM is not responsible for errors, delays, or failures caused by payment providers.

Transactions that fail, are reversed, or are subject to chargeback may result in the deduction of corresponding PTT from your balance, account restriction, or account suspension. Attempting to abuse refund or chargeback mechanisms constitutes a violation of these Terms.

All purchases are final unless otherwise required by applicable law or expressly stated by EXM for a specific promotion or circumstance. Refunds, where offered, are at EXM's sole discretion.

6. Gameplay

PesaTu matches operate as follows: a player creates or joins a room with a specified entry cost in PTT. Once the required number of players has joined and all entry costs are paid, the match begins. Players compete according to the Game's rules. At the conclusion of the match, the winner receives the prize pool — the total entry costs from all participants, minus the platform fee.

The platform fee is a fixed percentage of the total entry costs, retained by EXM as a service charge for operating the platform. The fee percentage is displayed before you confirm entry into a match. By entering a match, you agree to the platform fee.

Match outcomes are determined by player performance within the Game's mechanics and are validated by the Game server. EXM does not influence, predetermine, or manipulate individual match results.

Disconnections and Abandonment

If you disconnect from a match in progress, the Game server will determine the outcome based on the state at the time of disconnection and the applicable match rules. Disconnecting does not guarantee a refund of your entry cost. Repeated disconnections or suspected intentional abandonment may result in account restrictions.

7. Fair Play

You agree to compete fairly. The following conduct is prohibited and may result in immediate account suspension, forfeiture of token balances, and permanent termination:

• Using bots, scripts, automation software, or any program that simulates human input or automates gameplay.
• Exploiting bugs, glitches, or unintended game mechanics for competitive advantage.
• Colluding with other players to predetermine match outcomes or share winnings.
• Match manipulation, including intentionally losing, win-trading, or coordinating actions with opponents outside the normal scope of gameplay.
• Using multiple accounts to enter the same match, circumvent limits, or obtain unfair advantages.
• Interfering with, disrupting, or attempting to compromise the Game server, client, or network infrastructure.
• Fraudulent payment activity, including using stolen payment methods, making unauthorised transactions, or misrepresenting your identity to payment providers.
• Creating or manipulating token balances through exploits, errors, or any means other than legitimate gameplay or authorised purchases.
• Abusing refund, chargeback, or dispute processes to obtain tokens or value without authorisation.

8. Rewards and Redemption

Tokens won through gameplay (Rewards) are credited to your account balance upon match completion. Rewards may be redeemed through the platform's redemption flow where available. Redemption availability, processing times, minimum and maximum amounts, and applicable fees vary by jurisdiction and payment provider.

EXM does not guarantee that Rewards can be redeemed in all jurisdictions or through all payment methods. Exchange rates applied by payment providers may affect the local-currency amount received. Redemption requests may be subject to review for compliance with these Terms, applicable law, and fraud prevention. EXM may delay or cancel a redemption request where required for compliance or security reasons.

EXM's token accounting uses its defined internal model. The number of tokens shown in your balance is the authoritative record of your PTT holdings for all purposes within the platform.

9. Prohibited Conduct — Additional

In addition to the Fair Play rules above, you agree not to:

• Harass, threaten, abuse, or impersonate other players or EXM staff.
• Reverse engineer, decompile, disassemble, or attempt to derive source code from the Game client or server components.
• Modify the Game client, use modified clients, or create derivative works based on the Game.
• Use the Game for money laundering, terrorist financing, or any illegal activity.
• Attempt to gain unauthorised access to other players' accounts, the Game server, or EXM's internal systems.
• Publish or distribute private information about other players without consent.

10. Intellectual Property

PesaTu and all associated content — including but not limited to the game client, server software, graphics, audio, user interface, trademarks, logos, and branding — are the exclusive property of EXM Games. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Game solely for personal, non-commercial entertainment purposes in accordance with these Terms. This license does not grant you any ownership rights.

11. Platform Availability

EXM does not guarantee uninterrupted or error-free operation of the Game. The Game may be unavailable during maintenance, due to technical issues, or because of circumstances beyond EXM's reasonable control — including third-party service outages, network disruptions, or legal and regulatory requirements. EXM may modify, suspend, or discontinue features, match types, supported platforms, payment methods, or country availability at its discretion.

12. Disclaimer of Warranties

The Game is provided "as is" and "as available" without warranties of any kind, whether express or implied. To the maximum extent permitted by law, EXM disclaims all warranties including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. EXM does not warrant that the Game will meet your expectations, that gameplay outcomes will be favourable, or that the Game will operate without interruption or error.

13. Limitation of Liability

To the maximum extent permitted by applicable law, EXM Games, its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of tokens, loss of data, loss of revenue, or loss of goodwill — arising from your use of or inability to use the Game, regardless of the legal theory under which such liability is asserted.

In jurisdictions that do not allow the exclusion or limitation of certain warranties or liabilities, EXM's liability is limited to the minimum extent permitted by law. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation, where such exclusion or limitation is prohibited by law.

14. Changes to Terms and Services

EXM may update these Terms from time to time. Material changes will be communicated through the Game client, website, or email where reasonably possible. Continued use of the Game after changes take effect constitutes acceptance of the updated Terms. If you do not agree with the updated Terms, you must stop using the Game and may close your account. Changes to fees, limits, payment methods, supported countries, redemption rules, and game mechanics may also be made in accordance with this section.

15. Governing Law

These Terms are governed by and construed in accordance with the laws applicable in the jurisdiction where EXM Games operates, without regard to conflict of law principles. Any dispute arising from these Terms shall be resolved in the courts of competent jurisdiction in that location. If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full effect.
